Dr. Roman Schildbach
As an Attorney at ByteLaw I use my expertise in various areas of IT law for the benefit of our clients. I represent them in court, in their communications with government agencies, and in an advisory capacity in out-of-court matters.
In addition to IT contract and IT security law, a particular focus of my work is on issues of European and German data regulation and data protection law.
I have particular expertise in the complex area of health data protection law. For example, I develop approaches to the data protection-compliant merging, analysis and research of health and patient data or to access to data for research purposes. Another focus of my work is on issues related to the regulation of software and hardware, for example in the context of the Cyber Resilience Act or the AI Act.
In general, I support our private and public sector clients in the legally compliant implementation of new and innovative technologies. In doing so, it is important to me to balance the protection of the privacy of data subjects with the legitimate interests of the controller by finding practical solutions. Data protection and IT law should not and must not be an obstacle to innovation here.
After studying law at the University of Regensburg, I passed the first state law examination in 2019 and then worked as a research assistant at the University of Regensburg for three years. At the Chair of Public Law, Real Estate Law, Infrastructure Law and Information Law, held by Prof. Dr. Jürgen Kühling, I researched and taught, among other things, telecommunications law, media law, energy law, administrative law, constitutional law and data protection law.
At the same time, I completed my doctorate on a health data protection issue and worked as a legal expert for private and public clients.
I then passed my second state law examination in 2024 in the Higher Regional Court district of Frankfurt am Main. I was able to complete my training at the Hessian Commissioner for Data Protection and Freedom of Information in Wiesbaden, at Bytelaw in Frankfurt am Main and at the Federal Constitutional Court in Karlsruhe.
